Chrysler, Jeep® and Dodge Rewards Programs
Terms and Conditions

Please read this document carefully and keep it in a safe place as it sets out the terms and conditions (the “Terms and Conditions”) of each of the Chrysler, Jeep and Dodge loyalty rewards programs (hereafter referred to as, the “Program” but, in each case throughout this document, should be read as either the “Chrysler Program”, “Jeep Program” or “Dodge Program”, depending upon which loyalty rewards program you are a member of) for the MBNA® MasterCard® credit card account (hereafter referred to as, the “Rewards Credit Card” but, in each case throughout this document, should be read as either the “Chrysler Rewards Credit Card”, “Jeep Rewards Credit Card” or “Dodge Rewards Credit Card”, depending upon which credit card you have been issued) that is eligible to earn and accumulate points (“Reward Points”) that can be applied against the value of goods or services purchased from Chrysler, Jeep or Dodge dealerships (hereafter referred at as, the “Dealerships” but, in each case throughout this document, should be read as either the “Chrysler Dealerships”, “Jeep Dealerships” or “Dodge Dealerships”, depending upon which loyalty program you are a member of) as described in these Terms and Conditions.  Each Customer is automatically enrolled, at no additional cost, in the Program corresponding to the Rewards Credit Card issued to such Customer.  However, certain eligibility criteria (described below) must be met in order to earn and redeem Reward Points under the applicable Program.

It is important to note that the Terms and Conditions set out in this document: (i) relate solely to the Program in which a Customer is enrolled; (ii) supersede any and all previously published terms and conditions relating to such Program; and (iii) are separate and distinct from the terms and conditions relating to the Rewards Credit Card issued to such Customer.

  1. Definitions.   In addition to the terms defined above or elsewhere in this document,

    “Account” means the account that records all Reward Points earned by a Customer from eligible Rewards Credit Card transactions and promotional programs in connection with the Program in which the Customer is enrolled;

    "CF" means Chrysler Financial.  A business unit of DaimlerChrysler Financial Services Canada Inc.;

    “MBNA” means MBNA Canada Bank; and

    “you”, “your” and “Customer” mean any individual who is a cardholder of the Rewards Credit Card.

  2. Acknowledgement.   The use of your Rewards Credit Card will constitute your acknowledgment of and agreement with each of the Terms and Conditions described in this document relating to the Program that corresponds to the Rewards Credit Card issued to you.
  3. Participation Eligibility Requirements.   To be eligible to participate in the Program (i.e., both earn and redeem Reward Points) in which you are enrolled, you must satisfy each of the following conditions:

    a)     be a Customer in good standing with a Rewards Credit Card that has active charging privileges;
    b)     be a member in good standing of such Program;
    c)     be an individual (corporations, partnerships, and other entities may not participate); and
    d)     reside within Canada.

  4. Loyalty Rewards Program.   The Program offers rewards in the form of Reward Points that are credited to your Account.  Reward Points awarded under the Program have no cash value.  Instead, Reward Points are accumulated and redeemable in the manner described below.  It is the sole responsibility of the Customer to determine the then applicable terms and conditions related to the Program in which the Customer is enrolled including, but not limited to, accumulation, redemption and expiration of Reward Points.

  5. Reward Points Accumulation.   Reward Points are earned and accumulated to your Account in the following manner:

    a)     You will receive two thousand five hundred (2,500) Reward Points upon your first purchase with your Rewards Credit Card which purchase is not subsequently rescinded, the subject of a charge-back request or otherwise disputed.  One (1) Reward Point will be added to your Account for every new one dollar (CDN$1.00) in Canadian funds (or Canadian currency equivalent) in Net Purchase transactions other than Net Purchase transactions at Dealerships.  Five (5) Reward Points will be added to your Account for every new one dollar (CDN$1.00) in Canadian funds (or Canadian currency equivalent) in Net Purchase transactions at Dealerships.  Following each billing cycle of your Rewards Credit Card account, all new Net Purchase transactions during such billing cycle will be totaled and multiplied by a factor of one (1) or five (5), as applicable.  The resulting number will determine the number of Reward Points earned by you during such billing cycle. In addition, from time to time, you may have opportunities to earn incremental or bonus Reward Points through special offers that will be accompanied by specific rules.  “Net Purchase” means the purchase of goods and/or services made by you or your authorized user(s) through the use of your Rewards Credit Card, plus or minus any adjustments made to your Rewards Credit Card in respect of those purchases. Net Purchases do not include, and you will not earn any Reward Points in respect of, interest charges; cash advance transactions (including credit card cash advance cheques, balance transfers and bank or automatic bank machine disbursements); balance(s) permissibly transferred between MBNA credit card accounts; cash advances re-designated as purchases; the purchase of money orders, wire transfers, bets, lottery tickets, or casino gaming chips; unauthorized charges (including those made with a lost, stolen, canceled or fraudulent Rewards Credit Card); credit insurance premiums; over-the-credit-limit fees; and other fees and charges assessed on your Rewards Credit Card.

    b)     Reward Points are not earned and available for redemption until they are posted to your Account.

    c)     Each Customer’s monthly Rewards Credit Card statement will reflect the number of Reward Points accrued during the previous billing cycle, bonus Reward Points earned, adjustments to Reward Points and such other information as may be determined by MBNA from time to time.  A Customer’s monthly billing statement will not show cumulative amounts or reflect redemptions of Reward Points.

    d)     If any Rewards Credit Card transaction that is subject to a billing dispute is credited to your Rewards Credit Card account, the Reward Points value of that transaction will be immediately deducted from your Account. However, if the disputed charge is reversed, then the Reward Points value of the transaction will be added back to the Account.

    e)     The Reward Points value of a transaction will be deducted from your Account balance when a credit is posted to your Rewards Credit Card for adjustments made for previously billed charges.

    f)     There is no limit on the amount of Reward Points that can be accumulated on an Account.

    g)     Reward Points cannot be used in partial or total payment of any amount owing in respect of your Rewards Credit Card account.

    h)     For new Customers, accrual of Reward Points will begin on the date on which your first retail purchase is charged to your Rewards Credit Card account. If you are already an MBNA customer and you convert your existing eligible credit card account to the Program, you will not begin accruing Reward Points until your Rewards Credit Card account has been created by MBNA and your first retail purchase is charged to your Rewards Credit Card account. Reward Points will not be awarded retroactively.

    i)     MBNA shall, at its sole discretion, be entitled to refuse awarding Reward Points if your Rewards Credit Card is being used for business as opposed to personal purposes, for fraudulent or otherwise illegal conduct or for conduct contrary to your Rewards Credit Card agreement with MBNA or for any other reason as determined by MBNA.

    j)     Except as otherwise provided in these Terms and Conditions, Reward Points will expire after eight (8) years from the date on which they are earned.

  6. Account Information.   Customers will receive regular detailed information about the status of their Account.

  7. Inquiries.   To make inquiries about the Program and/or your Account, Customers should contact the Program administrator (the “Program Administrator”) appointed by MBNA as follows:

    a)     by telephone 1 866-280-3998 (toll free);
    b)     by mail at 1801 McGill College Avenue, Suite 800, Montreal, Quebec, H3A 2N4; or
    c)     online at www.chryslerrewards.ca; www.dodgerewards.ca; www.jeeprewards.ca.

    The Program Administrator’s regular business hours are from Monday to Friday between 8 a.m. and 9 p.m. (E.S.T.) and Saturday between 8 a.m. and 5 p.m. (E.S.T.).

  8. Redemption.   The procedure for redeeming Reward Points is as follows:

    a)     Reward Points are redeemable for either: (i) vouchers (each, a “Voucher”) that can be used solely as a down payment toward the purchase price or lease amount of a new or used vehicle at a Dealership; or (ii) gift certificates (each, a “Gift Certificate”) which may be used at Dealerships to be applied toward: (I) the purchase of parts, service or accessories; (II) the purchase of branded merchandise; and/or (III) the purchase of any other product or service that CF and MBNA may agree to add to the Program from time to time.

    b)     Customers are solely responsible for requesting the redemption of Reward Points for either Vouchers or Gift Certificates.

    c)     Redemption of Reward Points for Gift Certificates can only be made through the Program Administrator.  Redemptions can be made in blocks of one thousand (1,000) or two thousand five hundred (2,500) Reward Points.  For every one thousand (1,000) Reward Points redeemed, you will receive a Gift Certificate of ten dollars (CDN$10.00) in Canadian funds and for every two thousand five hundred (2,500) Reward Points redeemed, you will receive a Gift Certificate of twenty-five dollars (CDN$25.00) in Canadian funds.

    d)     If the face value of the Gift Certificate(s) exceeds the price of the eligible goods or services, the Dealership will pay the difference to you in cash.

    e)     Redemption of Reward Points for Vouchers can only be made online at www.chryslerrewards.ca, www.jeeprewards.ca, www.dodgerewards.ca.
    You can redeem any amount of Reward Points for a Voucher.  One (1) Reward Point is redeemed for $0.01.  By way of example only, ten thousand five hundred Reward Points can be redeemed for a Voucher in the amount of $105.00.  Vouchers can only be used toward the down payment on the purchase or lease price of a new or used vehicle at a Dealership.  The full face amount of each Voucher must be used for the down payment.

    f)     Neither MBNA nor CF is responsible for lost or stolen Gift Certificates or Vouchers.

    g)     All applicable federal and provincial income or sales taxes, duty and other miscellaneous charges in connection with any purchase transaction, including, but not limited to taxes, provincial sales tax, harmonized sales tax, goods and service tax are the sole responsibility of the Customer.  Customers are also solely responsible for any and all duty, shipping, and handling charges that may apply to goods or services obtained.

  9. Tax.   Each Customer is solely responsible for any personal tax liability arising from their participation in the Program.  You should consult with your personal tax advisor in order to determine any personal tax consequences.  You understand and agree that neither MBNA nor CF will issue tax receipts in respect of the Program.  You hereby agree to release MBNA, CF and their respective affiliates from any and all claims in respect of any tax liability resulting from your participation in the Program.

  10. Interpretation and Disputes.   Any interpretations, questions or disputes regarding the Program shall be resolved at the sole discretion of CF and MBNA.  All decisions made by CF and MBNA shall be final.

  11. Privacy.   You consent to and authorize MBNA, its subsidiaries and affiliates and any non-affiliated third parties with whom any of the foregoing contract in order to manage the Program, to share information about you, your Rewards Credit Card and the Program as necessary to effect, administer, enforce, service or fulfil the terms of the Program.

  12. Amendments to Program.   The Program and its benefits are offered at the discretion of CF and MBNA. You understand and agree that CF and MBNA may at any time, with or without notice, change these Terms and Conditions in whole or in part including, but not limited to, the conditions of participation in the Program and the accumulation of Reward Points. You further understand and agree that any change may be implemented by CF and MBNA even though such change may affect the accrual amount of Reward Points already earned.

  13. Termination.   Either MBNA or CF may suspend or terminate the Program at any time upon ninety (90) days notice to you.  Any violation of the Terms and Conditions by you may result in liability for damages, termination of your Program eligibility and/or loss or revocation of Reward Points. Customers will be entitled to redeem accumulated Reward Points during the term of the Program and for the period expiring on the date that is six (6) months following the effective termination date of the Program.

  14. Transfer of Reward Points, Gift Certificates and Vouchers.   Reward Points are not transferable in any circumstance.  Gift Certificates and Vouchers may be used by you or by anyone to whom you give the Gift Certificate or Voucher.

  15. Disqualification/Forfeiture of Reward Points.

    a)     MBNA reserves the right to disqualify anyone from participation in the Program, refuse to award Reward Points and/or close your Rewards Credit Card account if, in MBNA’s sole discretion, you or any other person(s) using your Rewards Credit Card account, have breached the Terms and Conditions of the Program, including but not limited to acts of fraud or abuse.

    b)     If you voluntarily close your Rewards Credit Card account, any unredeemed Reward Points may be redeemed if your redemption request was received prior to receipt of your notice of cancellation. If your request is not received prior to your notice of cancellation, unredeemed Reward Points shall be automatically, immediately and irrevocably forfeited.

    c)     If MBNA cancels your Rewards Credit Card, whether due to fraud, abuse, non-payment, non-renewal, death or for any other reason, all unredeemed Reward Points shall be automatically, immediately and irrevocably forfeited.

  16. Waiver.   No delay or omission by CF and/or MBNA in exercising any right or remedy contained in these Terms and Conditions shall operate as a waiver of any of such rights and remedies nor shall it be interpreted as such.  CF and/or MBNA may, in their sole discretion, deviate from the strict observance, performance or compliance by the Customer of any of these Terms and Conditions.  Such deviations shall not alter, affect or prejudice any of CF’s and/or MBNA’s other rights or remedies and shall only be effective in the specific instance and for the specific purpose for which it was given and shall be deemed not to be a waiver of any other of CF’s and/or MBNA’s rights or remedies as a result of any other breach of these Terms and Conditions.

  17. Indemnification.   You agree to hold MBNA and CF and their respective directors, officers, agents, employees, affiliates, successors and assigns (collectively, the “Indemnitees”) harmless from and against all liability, causes of action, penalties, costs and claims, and will reimburse MBNA’s and the Indemnitees’ reasonable and actual expenses incurred in connection therewith (including legal fees and costs), arising from or related to your participation in the Program including, but not limited to, any delay, cancellation or failure to honour for any reason whatsoever any purchase transaction or other products promised to you upon the redemption of Reward Points, and any damages, injuries or disabilities suffered through use or consumption of any products obtained upon the redemption of Reward Points. You further agree that MBNA and CF have no liability to you in respect Reward Points. You agree that any recourse you may have in respect of a failure on the part of any person or entity, to deliver the products promised under the Program shall be solely as between you and such other person or entity.

  18. Address Changes.   It is the sole responsibility of each Customer to promptly advise CF and MBNA of any changes to such Customer’s mailing address or other contact information. Neither CF nor MBNA is responsible for any lost, misdirected or delayed mail or other communications or any consequences thereof and you agree to release CF and MBNA and their respective affiliates from any and all claims in respect of losses or damages resulting therefrom.

  19. Not Affiliated.   MBNA and CF are not affiliated in any manner and are not agents, representatives or employees of each other and no party has the power to obligate or bind the other party.  The Program and the Rewards Credit Card are independent of each other.  MBNA makes no representation as to the quality or fitness for use of any rewards offered under the Program and neither offers, endorses, nor guarantees any of the goods, services, information or recommendations provided by third parties to you.

  20. NO WARRANTIES.   ANY PRODUCT, SERVICE OR REWARD OBTAINED THROUGH THE PROGRAM IS PROVIDED “AS IS,” WITHOUT REPRESENTATION OR WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, MBNA, CF AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, SUPPLIERS, ADVERTISERS AND AGENTS EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT AND ALL WARRANTIES RELATING TO THE ADEQUACY, ACCURACY OR COMPLETENESS OF ANY INFORMATION PROVIDED AS IT RELATES TO THE PROGRAM. APPLICABLE LAW MAY NOT ALLOW THE EXCLUSION OF CERTAIN IMPLIED WARRANTIES OR DAMAGES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.  MBNA, CF AND THEIR RESPECTIVE AFFILIATES, SUPPLIERS, AGENTS AND SPONSORS DO NOT WARRANT THAT YOUR USE OF ANY REWARDS SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVER(S) ON WHICH THE SITE IS HOSTED ARE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ACKNOWLEDGE THAT YOU ARE RESPONSIBLE FOR OBTAINING AND MAINTAINING ALL TELEPHONE, COMPUTER HARDWARE AND OTHER EQUIPMENT NEEDED TO ACCESS AND USE THE SITE, AND ALL CHARGES RELATED THERETO. YOU ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF THE SITE AND YOUR RELIANCE THEREON.
